Nis (BoW) - SALE OF PROPERTY (AS A LEGAL PERSON) BY PUBLIC PROCUREMENT
According to the bankruptcy judge of the Commercial Court in Niš, object no. 1. St. 309/2004, from 29/08/2005, in line with Bankruptcy Proceedings Law articles 109,110,111, 112 and 113 (Official Gazette of the Republic of Serbia no. 84/04) and National Standard no. 5 of the manner and proceedings of converting property into cash (Official Gazette of the Republic of Serbia no. 43/05), and in line with the Board of Creditors of 11/05/2007, bankruptcy manager of the bankruptcy debtor:

ANNOUNCES
SALE OF PROPERTY (AS A LEGAL PERSON) BY PUBLIC PROCUREMENT
Property of the bankrupcy debtor:
1. Management building – Management (745 m2) at real estate registry parcel (REPR) No 1171 of real estate registry municipality (RERM) Niš-Crveni Krst;
2. Warehouse of ready made goods, with ambulance station (745 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
3. Department for processing small pieces of leather and furs (3.544 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
4. Department for processing big pieces of leather, with warehouse for textiles and chemicals (5.457 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
5. Restaurant building (408 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
6. Maintainance department (tool section, locker section, electric section, warehouse) (856 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
7. Department for ready-wear and fancy goods (3.195 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
8. Department for processing pork skin with laboratory (8.427 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
9. Old furnace and coal pit (480 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
10. New coal pit with fuel tanks and tech. Water tankers (315 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
11. Transformer (48 m2) at REPR No 1171 of RERM Niš-Crveni Krst;
12. Equipment, furniture and stockpiles of ready made products, according to the specification
(Note: List of all belongings of the bancrupcy debtor, as well as their status, is presented in detail in the Additional Documents)
Initial bid at public procurement: 122,909,850.00 RSD.
Deposit: 70,234,200.00 RSD.
All legal and physical persons may participate if:
1. After acquiring pro forma invoice, make payment for purchase of sales documentation 30,000.00 RSD (pro forma invoice can be obtained each working day from 9 a.m. to 1 p.m. in the premises of the bankruptcy debtor);
2. They pay for the deposit to the bankruptcy debtor current account no. 105-0000000007425-64at “AIK Banka A.D. Niš” or offer unconditional first rate bank gurantee payable at the first call, not later that 5 working days before the sale (deposit payment deadline is 21/11/2007). In case the guarantee is the first rate bank guarantee, its original must be shown to the Finance department of the Agency for Privatization together with the application form. If, at the public procurement, the buyer whose deposit was made through bank guarantee wins, he has 48 hours to settle the deposit sum from the public procurment day but before signing the sales contract, after which the guarantee will be given back to him;
- They sign the deposit reimbursment renunciation statement . The statement makes up the sales documentation.
After paying the deposit, not later than 21/11/2007, potential buyers due to timely records, have to enclose the application form to the trustee of the Agency for Privatization. The application form makes up the sales documentation
The public produrement is due 28/11/2007, at 11 a.m. at the following address: Agency for Privatization, 23 Terazije Street, Belgrade, 2nd floor, auditory.
Participant registration starts 2 hours before the public procurement and finishes 10 minutes before the public procurement, that is, from 09.00 to 10.50, at the same address.
The bankruptcy authority conducts the public procurement by:
- registering people who have the right to participate at the public procurement (have the license or are present in person),
- opening the public procurement and reading out the bidding rules,
- calling the participants to make their offer to the announced price, which they are ready to pay,
- keeping order at the public procurement,
- announcing the buyer when nobody else offers a higher price from the last offered price,
- signing the record.
The sales contract should be signed within 3 days from the public procurement, under condition that the deposit made by the guarantee is paid to the bankruptcy debtor account. The announced buyer is obliged to pay the rest of the sales sum within 15 days from signing the sales contract. Only after the buyer has paid the sales price and after acquiring a full payment certificate from the bankruptcy debtor, can the buyer acquire the right to recording of the real estate transaction, while he has the right to movable property from the moment of paying the sales price.
If the announced buyer does not sign the record, the sales contract or he does not pay up the sales price within the established deadlines and in the appropriate manner, he loses his right to deposit reimbursement, and the buyer with the second best offer wins.
The property is bought in the presented state and can be seen after buying the sales documentation, not later than 7 days before the public procurement, each work day from 9 a.m. to 1 p.m.
The public procurement participants who did not acquire the status of the buyer or the buyer with the second best offer, are given their deposits (guarantees) back within 8 days from the public procurement.
The buyer is wholly responsible for the taxes and expenses of the signed sales contract.
