FOR LEASING THE REIMAINING CONSTRUCTION SITES BY COMPETITIVE BID
In line with Act 81 of the Planning and Construction Law ("Official Journal of the Republic of Serbia ", no. 47/03 and 34/06), and Act 5 and 6 of the Decision on Leasing Construction Sites ("Official Journal of the City of Niš" no. 32/06, 40/07 and 76/07)
 
ADMINISTRATION FOR PROPERTY OF THE CITY OF NIŠ, places an
 
ANNOUNCEMENT
 
FOR LEASING THE REIMAINING CONSTRUCTION SITES BY COMPETITIVE BID
 
I - for building housing objects for individual housing, height P+1, location "Pasi Poljana" – Block 20 and 21:
 
1. CONSTRUCTION PARCEL 1:
- Cad. Parcel no.: 220/13 of 236 m2, 240/168 of 204 m2 ( total surface: 440 m2) CM Pasi Poljana;
2. CONSTRUCTION PARCEL 2:
- Cad. Parcel no.: 220/3 of 117 m2, 222/9 of 201 m2, 240/163 of 20 m2 (total surface: 338 m2) CM Pasi Poljana.
 
II - for building housing objects for individual housing, height P+1, row formation, location   ''PASI POLJANA''- Jurija Gagarina Street:
1. CONSTRUCTION PARCEL 1:
-cad. parcel no. : 108/7 of 278 m2, CM Pasi Poljana;
2. CONSTRUCTION PARCEL 2:
- cad. parcel no.:108/8 of 277 m2, CM Pasi Poljana;
3. CONSTRUCTION PARCEL 3:
- cad. parcel no.108/9 of 276 m2, CM Pasi Poljana;
4. CONSTRUCTION PARCEL 4:
- cad. parcel no.: 108/10 of 79 m2, 110/3 of 194 m2 and 109/2 of 02 m2
(total surface: 275 m2), CM Pasi Poljana;
5. CONSTRUCTION PARCEL 5:
- cad. parcel no.: 110/4 of 274 m2, CM Pasi Poljana;
6. CONSTRUCTION PARCEL 6:
- cad. parcel no.: 110/5 of 271 m2, CM Pasi Poljana;
7. CONSTRUCTION PARCEL 7:
- cad. parcel no.: 110/1 of 208 m2, 111/14 of 38 m2 and 111/15 of 24 m2
(total surface: 270 m2), CM Pasi Poljana;
 
III – for building housing objects for individual housing, location "Nikola Tesla" in accordance with the local office "N. Tesla" ("Official Gazette of the City of Nis" no. 37/01):
1. CONSTRUCTION PARCEL 1.
- Cad. Parcel no.: 2289/13 of 516 m2 CM Niška Banja;
2. CONSTRUCTION PARCEL 2.
- Cad. Parcel no.: 2289/14 of 471 m2 CM Niška Banja.
 
For locations form the proposition I and II:
The initial bid for leasing a construction site is 1,900.00 RSD per 1 m2, while the minimum bid is 50.00 RSD and the maximum is 100.00 RSD.
For locations form the proposition III:
The initial bid for leasing a construction site is 2,500.00 RSD per 1 m2, while the minimum bid is 50.00 RSD, and the maximum is 100.00 RSD.
The sum for leasing a construction site intended for for building housing objects can be paid in instalments.
The first instalment is 20% of the total sum and is paid at the latest 15 days from the day of signing the contract, and the rest in four equal half yearly instalments, with interest of the value of the National Bank of Serbia rate of discount at the annual level.
In order to make the claim the lessee is obliged, before signing the contract, to submit the letter of exchange with the acceptance of the lease holding with the signature of two eligible acceptors.    
The deadline for the implementation of the intended action is three years from the day of signing the contract for leasing the announced construction site.
 
IV – LEGAL STATUS OF THE LOCATION
- user: City of Nis.
 
V – PURPOSE OF THE SITE:
For the property form the proposition I and II – Individual – housing construction, housing objects for individual housing, max. object height P+1.
For the property form the proposition III – housing objects for individual housing; max. object height P+2+Ph.
 
VI - PUBLIC UTILITY IMPLEMENTATION ON THE LOCATION:
The locations form the proposition I and II are equipped with recquired infrastructure and the objects can be connected to it in line with the PE regulations. 
There is a pipe line and a waste waters network, and the road in Jurija Gagarina Street.  The road which connects blocks 20 and 21 is missing.
The location form the proposition III is equipped with recquired infrastructure and the objects can be connected to it in line with the PE regulations. 
There is a pipe line and a waste waters network and a road in Zaplanjska Street.
Thre is a pipe line network in 1. Maja Street.
In the newly designed street (between the planned childre's institution and the construction parcels 1, 2 and 3) there is no infrastructure; the property of the newly designed street is of the City of Nis.
 
VII - REIMBURSEMENT FOR THE CONSTRUCTION SITE ORGANIZATION
The investor regulates the reimbursement for the construction site organization through the contract with PE ''CONSTRUCTION INSTITUTE OF THE CITY OF NIŠ'', in line with the Decision on reimbursement negotiation and determination value for the construction site organization, which is active from the moment the contract is signed. 
 
VIII - RESPONSIBILITIES CONCERNING THE SITE ORGANIZATION
INSTITUTE
For the location form the proposition I:
The Institute is obliged, according to the annual construction design, to plan and build the road between blocks 20 and 21.
For the location form the proposition II:
The Institute has no further obligations concerning the location.
For the location form the proposition III:
The newly designed street will be equipped with infrastructure according to the annual construction design.
INVESTOR:
For the location form the proposition I:
After being granted the construction parcel one should recquest the Document on urban conditions and afterwards the permission for construction.
When being issued the Document on urban conditions pay attention to electric long distance lines for the cad. parcels from the proposition  II .
Within the location should provide connectors to the infrastructire.
Should participate in constructing electro and PTT network in line with the regulations of those authorized enterprises.
For the location form the proposition III:
After being granted the construction parcel one should recquest the Document on urban conditions and afterwards the permission for construction.
Within the location should provide connectors to the infrastructire.
Should participate in constructing electro and PTT network in line with the regulations of those authorized enterprises.
 
IX - GENERAL CONDITIONS, PROCEDURE AND DEADLINE FOR SUBMISSION
All legal and physical persons can participate at a competitive bid.
The right to the leased site has the investor who offers the highest amount.
For the locations from the propositions I and II:
Those who participate in the competitive bid are obliged to submit with the application a deposit of 57,000.00 RSD for the participation at the competitive bid for leasing the remaining sites, by placing a payment on the gyro account no: 840-742143843-93, with the reference number 97-87-521 - lease revenues of the construction sites for the benefit of the City of Nis and the proof should be given to the Administration for Property (office no. 21).
For the locations from the proposition III:
Those who participate in the competitive bid are obliged to submit with the application a deposit of 112,500.00 RSD for the participation at the competitive bid for leasing the remaining sites, by placing a payment on the gyro account no.: 840-742143843-93, with the reference number 97-87-521 - lease revenues of the construction sites for the benefit of the City of Nis and the proof should be given to the Administration for Property.
Applications for participating at the competitive bid are submitted to ADMINISTRATION FOR PROPERTY OF THE CITY OF NIŠ (office no.17), with "THE COMISSION FOR LEASING THE REMAINING CONSTRUCTION SITES" within 15 days from the announcement publication.
 
The application of the physical person who wants to participate at the competitive bid consists of:
 
1.                 Site indicator which is to be leased
2.                 Full name
3.                 Name and family name of one of the parents
4.                 Address, ID number and signature
5.                 Acceptance statement of the terms from the announcement
6.                 Proof of payment of the guaranteed amount 
7.                 Number of the account for paying back the guaranteed amount
The application of the legal person who wants to participate at the competitive bid consists of:
1.                 Site indicator which is to be leased
2.                 Firm and registration number
3.                 Full name of the director and his signature
4.                 Verified copy of the decision on registration or a verification of the submitted
request for entering the registry of the Agency for Economy Registers.
5.                 Verified copy of the permission for representation at the competitive bid issued
by the authorized entity
6.                 Verified statement of the authorized person of accepting all the terms from the
announcement
7.                 Proof of the paid deposit
8.                 Number of the account for paying back the deposit
 
One who submits an untimely and untidy application will not be able to acquire the status of a participant at the competitive bid.
The site in question will be leased to the period of 99 years to a bidder who offers the highest reimbursement amount.
 
X – The participant to whom the site is leased to, the guaranteed amount is included in the total sum, while to the other participants, after the competitive bid process, on their request, the guaranteed amount is paid back without any right to interest.
The competitive bid will be held 02/11/2008 (February 11) at 10 a.m., office no. 61, second floor of the City Administration of the City of Niš, Nikole Pašića 24 Street.
 
The outcome of the competitive bid will be distributed to the participants and put up on the notice board of the City Administration and PE ''Construction Institute of the City of Niš", within 8 days from the day of producing the document of leasing the site. 
After the document of leasing the site has been produced the investor is obliged to sign the contract on leasing the site and the contract on the reimbursement amount for the site organization.
The investor, who resigns to sign these contracts, as well as the person by whose fault the contract is breached, has no right to the guaranteed amount reimbursement.
